Supreme Courts decision to remove Trump from the primary ballot

The Supreme Court is looking into wheater or not republican front-runner Donald Trump can continue to run for president after he allegedly tried to engage in an insurrection back in January 2020. “The plantiffs in the case argue that Trump’s actions in the aftermath of the 2020 presidential election automatically disqualify him from office.” NPR.com (https://apple.news/AOX1q5DvkRIaKMCh2S2dd5A)



The planiffs of this case are relying on section 3 of the 14th amendement stating the following:

So the question that stands is, does the 14th amendment apply to Trump?


Simply put, section 3 states that anyone who engages in an insurrection after taking an oath to uphold the constitution is prohibited from holding public office. 


Trumps refusal to transfer power peacefully is a first for American presidency. Trumps legal team is arguing that the language in the 14th amendment is not clear enough to apply to this situation and that he did not engage in the insurrection on January 6. Despite now facing 91 criminal charges across 4 jurisdictions, he was not impeached or convicted a few weeks after the riot on the Capitol. 


In this case, the courts have a few options. They could side with Colorado, and disqualify Trump from the ballot. They could leave it up to lawmakers and voters - stating this is not for the courts to decide. Or they could keep Trump on the ballot to have a chance of being president again. 


While there is a lot of grey area in this case, it is shocking to me that the courts even have the option of leaving it up to voters and that he would have a shot at presidency again. It is hard to not see how he positioned himself and brought the insurrection to life back in 2020. Trump and his supporters had something planned all along. His threats were not taken seriously. He stated himself that he would not go easily.

  1. I did not know that trump did this and while it was done when he was out of office the fact that he has been a president prior and plans for reelection in the 2024 elections is mind blowing. While the supreme court is in charge of interpreting amendments for cases that post the threat of violating them i feel that this event should not be up for discussion. It shows what trump is willing to do regardless of how it looks to the public.

  2. The Supreme Court has a major decision to make when it comes to Trump’s eligibility. It is true that Section 3 of the 14 Amendment prohibits those who incited an insurrection from holding public office. Did Trump engage in insurrection on January 6th, 2021? That is the question the Court will have to wrestle with. Their decision will drastically affect how the 2024 election unfolds. If Trump is found guilty, it opens the door for a different Republican candidate to run for the presidency. A candidate like Nicki Haley will have a far stronger chance to win the election. If Trump is found innocent, it will be a showdown between Trump and Biden for the presidency. Trump will have to try to win back the country that voted against him in 2020.
